UPTON BY CHESTER & DISTRICT PARISH COUNCIL

Meeting of the Planning Committee of the Upton by Chester & District Parish Council held on Thursday 26th May 2005 at The Pavilion, Wealstone Lane, Upton, Chester.

 

Present:

1.                  APOLOGIES:

Apologies were received from Cllr Jean Evans, Cllr Liz Warrington, Cllr Gill Jordan and Cllr Gerald Grant.

 

2.                  DECLARATIONS OF INTEREST:

 

None declared.

 

3.                  TO CONSIDER PLANNING APPLICATIONS:

a.       Land at West Corner of Newhall Road/Handford Road – 10m slimline flexicell column, outdoor cabinet and equipment cabinet.

 

                        Members object for the following reasons:

            Consultation – Upton Parish Council did not receive any pre-application notice of this application and therefore were not involved in any pre-application discussions. The Code of Best Practice on mobile phone network development stresses the importance of this contact.

Permitted Development – The regulation states that a site notice should be posted for 21 days. To the Council’s knowledge this has not been done.

Due to the above, there has been insufficient time for the local community to consider the proposals or consider any realistic alternative schemes.

Siting and Appearance – The proposed mast, as well as being near a high density of housing, will be prominent and will intrude into the skyline viewed from every direction. This fails the criteria on the Local Plan DENV91fc, which only allows schemes that have minimal effect on the visual amenity of the area.  Other sites have been rejected due to the proximity of housing and this area has a high volume of elderly people and young children.

The proposed site is at one of the approaches to Reconciliation Wood where a number of specimen trees have been planted with the support of local donations as a remembrance of those who fell during the wards and is due to be expanded in the near future. The mast would have an adverse effect on this area so it therefore fails to meet the criteria of Policy DENV91fc.

The area suffers from vandalism and graffiti on the equipment cabinet would add to its unsightliness. If damage to the cabinet were to occur, then the operator would need to fence the equipment at some later stage.

 

 

The present mast is causing an obstruction as vehicles emerging from Handford Road into Newhall Road cannot be clearly seen and the same would then apply on the other corner.

There will be a loss of pavement which would not leave enough room for double buggies or wheelchairs.

Members would like Mobile Telephone Companies to be asked to provide long term plans for masts rather than receiving applications for one-off masts.

 

b.      54 Apraham Crescent – Conservatory to the rear.

 

            No objection

c.       6 Endsleigh Gardens – Removal of existing flat roof and replacing with new pitched roof and removal f existing chimney stack.

 

                        No objection

 

d.      45 Queens Crescent – Two storey side extension and single storey front and rear extensions.

 

                        No objection

 

e.       28 Tewskesbury Close – Extension to existing rear dormer

 

                        No objection

 

f.        12 Demage Lane – Demolish and rebuild garages

 

                        No objection

 

g.       14 Flag Lane North – Two storey side and single storey rear extensions.

 

                        No objection

 

h.       2 Linksway – Rear single storey extension and rear first floor infill extension.

 

                        No objection

 

i.         5 Windmill Rise – Gable extension and dormers for loft conversion

 

                        No objection

 

j.        35 Gatesheath Drive – Single storey front extension to porch ad garage.

 

                        No objection

 

k.      10 Bache Drive – Amended Application. Demolition of existing garage and utility, erection of to storey side extension.

 

                        No objection

 

l.         Upton Heath County Primary – Library extension.

 

                        No objection but members would like to see a condition of planning to              ensure the reinstatement of the lost car parking spaces in the future.

 

m.     30 Daleside – Two storey side extension and single storey rear extension.

 

                        No objection

 

n.       6 Bache Drive – Two storey extension to side, enclosure to porch and single detached garage to front of property.

 

                        Memberw have no objection to the proposed extenson to the building,              but are concern about the proposed postoning of the new garage.  As                   this will be right up to the front boundary, apart from being in front of                         the building line it would alo cause health & safety problems with                                   regard to the roadway as:

 

a.                   Cars using the nearby roadway may not see a car emerging from the garage.

b.                  The driver of the car leaving th garage will not have a clear view of the roadway until the car is already on the roadway.

                       

o.      26 Church Lane – First floor extension to side d ground floor extension to rear.

 

                        No objection

 

p.      Upton by Chester High School -  Demolition of existing drama studio and construction of new drama/dance/P.E. facilities with offices.

 

                        No objection to the proposed building but have concerns about the                               effect of the construction work on local residents.  They therefore would                   ask the following:

 

i.                     That construction traffic not be allowed to use St James Avenue and that maybe a temporary access would be created off th A41 for this purpose.

ii.                   That no construction work is done afetr 6pm or at weekends.
